Divorce and Separation

Our firm can assist you with the legal procedure of terminating your marriage. Divorces in Canada are regulated by the Divorce Act, the act sets out guidelines for all the issues related to divorce such as child custody, child and spousal support, and property division.

Child Custody and Access

Custody and access can be a sensitive issue to resolve when the divorce occurs. The parent that has custody of the child will have the right to determine things such as schools, educational plans, medical treatment etc. Expertise in the field is often needed for providing the client with the best possible outcome.

Child and Spouse Support

After the separation, the amount of child and spousal support must be determined. Financial support assists a spouse with financial costs associated with caring for the child, assists a spouse with their financial needs after the breakdown of the marriage, and to compensate a spouse for sacrificing their ability to earn income during the marriage.

Property Division

After the termination of the marriage, some disputes may arise when determining the appropriate division of property. Under Canadian law, any kind of property that was acquired by one of the two spouses during the duration of the marriage (and still exists at separation) must be divided equally upon separation. Property can include matrimonial homes, pensions, furniture, etc.

Adoption

Adoption is the legal means by which people can permanently take on the responsibility of caring and raising a child. The Child and Family Services Act sets out the rules for the adoption of children living within Ontario.
